Misclassification of Employees to Avoid Paying Overtime Wages: Many employees are told that because they are paid a salary they are not entitled to overtime. Being paid a salary is not the determining factor for whether or not you should be paid for the overtime hours you work. There are only limited circumstances in which an employer is not required to pay overtime. We are currently investigating a number of employers who appear to be violating these overtime laws. Employees Not Receiving Uninterrupted Meal Breaks: Did you know that most employees are entitled to a 30 minute uninterrupted meal break if they work five or more hours per day? During the meal break the employee must be relieved of all duties and be permitted to leave the building. Working at a business where there is “downtime” during portions of the day but the employee still can’t leave the premises does not necessarily count as a meal break. We are currently investigating a number of employers who do not appear to be providing meal and rest breaks. Contact us at (800) 611-3331 for more information. |
False or Misleading Advertising In Food Labeling: Are you trying to watch your weight so you carefully read the labels on the foods you buy? Do you think that a particular product misrepresents the number of carbohydrates or grams of fat it contains? We are currently investigating a number of products that appear to have misleading or incorrect labeling. Contact us at (800) 611-3331 for more information. |
Apartment Rental Security Deposits: If you have recently rented property and the landlord refused to return your security deposit, under certain conditions you may be entitled to receive some or all of your deposit back. In order for a landlord to keep any portion of your security deposit due to cleaning or repairs, you must be provided with an itemized statement listing what needed to be cleaned or repaired within 21 calendar days after you vacated the premises. We are currently investigating a number of landlords that appear to have improperly kept security deposits. Contact us at (800) 611-3331 for more information. |
