  How do I know if I have a case?
Because the law is always changing, it is best to consult an attorney to determine if you have a viable case. It is also important to keep in mind that the law is designed to protect rights we as a society have decided are important. If you think you have been treated unfairly, that is usually a good indication that you might have a case.
  How long does a lawsuit take?
It depends on the nature of the case and the law firm handling the case as to how long a lawsuit will take. At Callahan McCune & Willis, our clients benefit from our years of experience in multiple types of litigation so we don’t need to “re-invent the wheel” for every case. We use this experience to efficiently and effectively move a case along to resolution. Depending on the case and the client’s needs, a court proceeding may not always be the most effective means for resolving a dispute. That’s why we always consider alternative solutions such as mediation, arbitration, or simply sitting down and talking with the other side.
  What is a class action?
A class action is where one or more persons sue on behalf of a large group. To qualify as a class action, all the persons in the group must have been affected in the same way. The person who sues is know as the class representative and all the other people in the group are called class members. Class actions require court approval.
  How much will it cost me?
It depends on the arrangement you make with your lawyer. At Callahan McCune & Willis, most cases are taken on a contingency fee basis where we only get paid if you recover.
  Can I be fired if I participate in a lawsuit against my employer?
In California, the law protects you from being retaliated against if you participate in litigation against your employer. Our experience to date has been that most employers understand they cannot fire an employee for suing. Should your employer chose to ignore the law, you have the right to sue them to recover lost wages and, in some cases, punitive damages designed to punish them for their actions. At Callahan, McCune & Willis, we keep an open dialogue with our clients so if there is any indication they are being retaliated against we can take action to protect their rights.
